The District is an independent special district approved by the Butte County Board of Supervisors in 1952 to provide a respectful, low-cost place of burial to meet the needs of the diverse, local communities of Magalia, Stirling City, Nimshew, and Coutolenc. The District owns and maintains four active cemeteries and various inactive pioneer and historic cemeteries. The District is managed by five trustees appointed by the Board of Supervisors, who serve two-year terms. The District recommends the Board of Supervisors appoint Nirvana Haver as a Trustee to the District, with a term ending July 31, 2022. (Other - Kimshew Cemetery District)

County Administration recommends entering into an employment contract with Narinder Sufi as the Director - Libraries/County Librarian. The term of the contract is September 17, 2020 through September 16, 2023. The contract includes a proposed annual salary of $105,000. (County Administration)

Over the past several months, the County and the bargaining team for STU have met and conferred over a successor MOU. STU has ratified the terms of the County's offer for a successor MOU that will supersede and replace the current MOU that expired on April 17, 2020. Consistent with Board direction, the agreed upon changes contained in the MOU are: 1) a one year term; 2) conduct a classification and compensation study at an appropriate and feasible time; 3) a one-time Christmas Eve holiday on December 24, 2020; and 4) an increase in the Compensated Time Off (CTO) cap from 80 hours to 100 hours. This successor MOU is based on the MOU that expired on April 17, 2020 and the only changes to the expiring agreement are those changes agreed to above as well as some minor cleanup of outdated language. The term of the MOU is from Board adoption through June 30, 2021. (Human Resources)

The majority of Butte County bargaining unit agreements contain a provision that authorizes a bilingual premium/differential. This provision is absent in the current Salary and Benefits Resolution for the Board of Supervisors Executive Assistants. In an effort to standardize eligibility for bilingual pay, Human Resources recommends amending the current Executive Assistant, County Supervisor Salary and Benefits Resolution to match the bilingual premium/differential provisions in place with the other bargaining units. All other provisions remain the same. The recommended resolution will supersede and replace the existing resolution. (Human Resources)

After an extensive recruitment for the position of Health Officer, the Department of Public Health has made an employment offer to Dr. Robert Bernstein, MD Pursuant to Article IV of the County Charter, the Health Officer is an appointed position whose term is not-to-exceed four years. The Department recommends entering into an employment agreement with Dr. Robert Bernstein to serve as the Health Officer for Butte County. The annual salary of the position is $201,679. The contract also includes a cell phone stipend of $70 per month, a mileage reimbursement of $250 a month, and relocation assistance of up to $3,000. The term of the agreement is August 17, 2020 through August 16, 2024. (Public Health)

Pursuant to Water Code section 50731, the Board of Supervisors shall appoint a time and place for holding a general district election (election) for the unexpired term of trustees serving on a reclamation district board upon receipt of a verified petition of 20% of the landowners within the district who, together, own at least 20% of the value of the lands in the district, as determined from the last tax roll of the County. On July 20, 2020, a petition was filed with the Clerk of the Board, and was verified by County Counsel on July 22, 2020. The petition meets the 20%/20% threshold based on the January 2020 Butte County Assessor's database. The total acreage of all parcels within the District is 4,625.72 acres. The total assessed value of all parcels in the District is $54,436,841. The assessed land value of all parcels in the District is $20,294,501. The Petitioner submitted signatures from landowners who together own 1,855.32 acres in the District (40.1% of District acreage), with an assessed total value of parcels of $18,493,920 (33.97% of assessed total value in District) and an assessed land value of $7,950,455 (39.17% of assessed land value in District). Pursuant to Water Code section 50731, the election shall be held not less than 75 days (Saturday, October 3, 2020) or more than 90 days (Saturday, October 18, 2020) after receipt of the petition. Pursuant to Water Code section 50705, the polls shall be kept open from 10:00 am until 4:00 pm. Petitioner proposed 5470 Wilson Landing Road, Chico, a parcel within the district boundaries owned by a landowner of the district, for the location of the election. The Petitioner requested the election be held at the soonest available date. The District did not propose a location for the election, nor indicate a preferred date for the election. Additionally, Water Code section 50700 directs that the election be conducted by an Election Board consisting of one inspector and two judges of election which shall be comprised of three landowners of the District or legal representatives, who shall be appointed by the Board of Supervisors. As this is the first election held in the history of the District, an Election Board has never been appointed. The Petitioner has nominated the following people for appointment to the Election Board: Kevin Rice as the Inspector, and Jeff Shimizu and Richard Wallace as Judges. All are landowners within the district. The District did not put forth any nominations. Pursuant to Water Code section 50751, should the Board of Supervisors fail to appoint an Election Board, the voters present at the opening of the polls may appoint the Election Board.
