2.01 Adoption of an Urgency Ordinance Amending Butte County Code Chapter 53, Article I - "Findings and Title," and Article IV - "Emergency Interim Housing Inside the Camp Fire Area" - Pursuant to California Constitution Article XI, Section 7 and Government Code sections 25123(d) and 25131, the Department of Development Services proposes the adoption of an urgency ordinance which amends Chapter 53, Articles I and IV, in order to remove language that allows survivors of the Camp Fire to reside in temporary dwellings on properties within the Camp Fire burn area with fire debris from a structure 120 square feet or larger. This action is necessary to eliminate the possibility that allowing survivors to reside in temporary dwellings on such properties "may impact the justification for Private Property Debris Removal (PPDR) activities and federal reimbursement of PPDR costs as the justification for the reimbursement of PPDR costs is based on the State and County's identified need to eliminate immediate threats to life, public health, and safety." All other portions of Chapter 53, regarding temporary dwellings for fire survivors, remain in place. The staff report provides details on the options that remain available for placing temporary housing, as fire survivors wait for their property to be cleared under Phase II Debris Removal. The Urgency Ordinance will take effect immediately upon a four-fifths approval of the Board of Supervisors - action requested - 1) WAIVE THE FIRST READING OF THE ORDINANCE; AND 2) ADOPT THE ORDINANCE OF THE COUNTY OF BUTTE AMENDING ARTICLE I, ENTITLED "FINDINGS AND TITLE," AND ARTICLE IV, ENTITLED "EMERGENCY INTERIM HOUSING INSIDE THE CAMP FIRE AREA," OF CHAPTER 53, ENTITLED "CAMP FIRE DISASTER RECOVERY ORDINANCE" AND AUTHORIZE THE CHAIR TO SIGN (4/5 VOTE REQUIRED).
